How to import chemicals from China into Malaysia.

The route as it actually runs: what the tariff line decides, what the Form E saves, where the sales tax lands, the exemption machinery most importers never hear about, and the ninety-day window that gives the tax back. Written by the desk that builds the paper packs these clearances run on.

THE ROUTE AT A GLANCE · 流程速览

  1. Fix the HS code first. Duty rate, sales-tax rate, permit gates and any exemption all hang off it.
  2. Ask for a Form E with the goods. Under ACFTA, most industrial chemical lines enter at preferential zero duty.
  3. Budget sales tax at 5% of CIF on most industrial chemical lines (10% on some) — unless an exemption applies.
  4. If the goods feed a registered manufacturer, the Schedule C machinery (C1/C3) can remove the tax before it is paid.
  5. Clear on a K1. Re-export within three months on a K2 and the tax comes back as drawback.
  6. The paper pack sets the clock: invoice, packing list, B/L, batch COA naming the plant, SDS, Form E.

STEP 01 · 先定税号Start with the HS code, not the price

Every other number in this guide is downstream of one decision: which line of Malaysia's customs tariff your product sits on. The ten-digit code fixes the import-duty rate, fixes whether sales tax runs at 5% or 10% or not at all, tells you whether an import permit gate applies, and later decides whether an exemption claim survives its match test. Get it wrong and every calculation after it is wrong.

Your Chinese supplier will quote their eight-digit CN code. Useful as a starting point, but classification is done under Malaysia's tariff, and the two do not always land on the same line. Chemicals mostly live in chapters 28–39; the traps are blends and preparations, which can jump from a pure-substance line to a preparation line with a different rate and a different permit answer. For an ambiguous product, a customs ruling or a forwarder who handles chemicals weekly is cheaper than a mis-classified container.

A mis-classification does not just change the tax. It invites a query, and a queried container sits while the meter runs.

STEP 02 · 关税与销售税The duty stack: what you actually pay at the gate

Three layers can apply to a chemical import. In practice, two matter:

The 2025 change that outdated everyone's cost sheets: Malaysia expanded the sales-tax net from 1 July 2025. Lines that had cleared tax-free for years now carry 5%. If your landed-cost model predates July 2025, rebuild it before you commit to a selling price.

WORKED EXAMPLE — ONE LOT, CIF PORT KLANG USD 30,000

Sales taxCIF + duty5%USD 1,500
Same lot, no Form Eduty at the line's MFN rate, then 5% on top of bothline-dependentmoney left on the table

Illustrative math on a clean 5%/0% line; your tariff line sets the real rates. The USD 1,500 is the number the exemption machinery and the drawback below are fighting over.

STEP 03 · 豁免机制The exemption machinery: Schedule C, C1 and C3

This is the part of the system that almost never gets written down in English. What follows is how it runs in practice: field knowledge from people who operate it, not a statute paraphrase. Scope your own case with a licensed customs agent, and treat the RMCD's current guidance as the law.

Malaysia's sales-tax regime exempts inputs that feed registered manufacturers — the state does not want to tax raw material on its way into local production. The machinery lives in the exemption schedules (administered through the MySST system), and it has two doors:

THE TWO DOORS — WHO CLEARS THE GOODS TAX-FREE
RouteWho you areWhat it takesWhat happens
C1Registered manufacturerYour own registration; goods are your raw material / componentImport in your own name, exemption applies at the gate
C3Trader importing on behalf of a registered manufacturerThe manufacturer's appointment (appointment letter) naming youYou clear the goods; the manufacturer's exemption travels through you

The match test. The exemption is approved against a specific picture: this product, this HS code, this manufacturer. At the gate, all three must match the registration. A different grade, a re-classified line, a manufacturer whose paperwork lags — any drift and the exemption is refused, and the tax is due in cash, that day.

The allocation is finite. Approved quantities behave like an allocation, not a standing right: once the approved volume is drawn, it is gone until the registration is amended. The time to coordinate quantities with the manufacturer is before the vessel sails, not after arrival.

The rebrand route. As practiced, a genuine repacking operation under your own brand can qualify a trader to register as a manufacturer in its own right, which changes the whole tax posture. The packing discipline that comes with it is strict: goods move onward in the same packing and name as registered, or they are repacked and registered under the seller's brand. This is exactly the kind of line item to scope with a licensed agent before building a business model on it.

The reporting tail. Exemption users report to customs on a fixed cycle — input and output records reconciled against the registration. The exemption is not a discount, it is a ledger: sloppy records unwind it retroactively, with the tax and the penalty arriving together.

STEP 04 · 退税窗口The drawback: export within three months, the tax comes back

If the goods do not feed a local manufacturer (say Malaysia is your staging point for the region), there is a second door. Pay the sales tax at import, re-export the goods within three months of payment, and claim it back as drawback. The export runs on a K2 declaration, and the claim lives or dies on whether customs can trace the exported goods to the imported ones.

CHINA PLANTGoods ship CIF — invoice, B/L, Form E, batch COA, SDS
PORT KLANG / PENANGK1 import declaration — duty 0% (Form E), sales tax paid
YOUR STOREGoods held — batch identity preserved, records kept
≤ 90 DAYS · K2Re-export declared — drawback claim recovers the tax

Three practice notes. The clock runs from payment, not from arrival at your store; weeks vanish faster than you think. Partial exports support partial claims, so a split lot is not a lost lot. And identity of goods must be provable: batch numbers that run unbroken from the plant's COA through your store records to the K2 are what make the claim boring, which is what you want a tax claim to be.

THE PACK, NOT THE PORT, SETS THE CLOCK · 文件决定速度

STEP 05 · 清关文件包The paper pack: what clears a chemical container

Clearance speed is not a property of the port. It is a property of the pack. This is what a chemical container clears on:

A pack where every name matches every other name clears quietly. Every mismatch is a question, and questions cost days.

FIELD NOTES · 常见错误Where importers actually lose money

  1. Classifying from the supplier's CN code without checking the Malaysian line — wrong tax, wrong permit answer, queried container.
  2. Skipping the Form E because "duty is only a few percent". A few percent of every container, forever, for one certificate per shipment.
  3. A COA that names a plant nobody on the B/L matches. Verification query at the gate; harder questions from your own customer later.
  4. Assuming the exemption travels with the goods. It belongs to the registration and its match test, not to the cargo.
  5. Missing the 90-day K2 window by three weeks because the clock started at payment, not at the store gate.
  6. Quoting customers off a landed-cost sheet from before July 2025. The 5% now lands on lines it never used to touch.

ANTICIPATED QUESTIONS · 常见问题Asked at the desk

Q1Do I need an import licence to bring in industrial chemicals?

There is no single general licence for ordinary industrial chemical lines. Control is line-by-line: specific HS codes carry permit gates for specific agencies, and dangerous-goods classes carry transport and storage rules regardless of tariff. The honest answer is always the tariff line's answer, which is why classification is step one.

Q2The seller quotes CIF. What is actually left for me to do?

CIF means the seller delivers the goods, freight and insurance to your port. Import clearance, duty and tax, and haulage from the port are yours. What a serious principal seller changes is not who clears; it is whether the pack you clear on arrives complete and internally consistent, so your forwarder files a boring K1 instead of answering questions.

Q3Can I claim the exemption after I have already paid the tax?

The exemption routes apply at import — they are set up before arrival, not recovered after. After payment, the door that remains is drawback: re-export within three months and claim. If the goods stay in Malaysia and you were eligible all along, fix the registration for the next container; the last one is tuition.

Q4How long does clearance take?

With a clean, internally consistent pack and no permit gate: routine. Every name mismatch, classification doubt or permit surprise adds days. The pack, not the port, sets the clock.

Q5Is the 5% legally avoidable?

Three legal doors, all above: an exempt tariff line, the Schedule C machinery if the goods feed a registered manufacturer, and drawback if the goods re-export within three months. Everything else is just paying it — and pricing it into the quote honestly.
